Reference Standards

The Consolidated Law on the Health and Safety of Workers (Legislative Decree 81/08, as amended) is the main legislative norm safeguarding the safety of workers, oriented towards improving their quality of life.
Art. 28 of Legislative Decree no. 81/08 reaffirms the principle according to which the assessment of risks borne by the employer must be “comprehensive.”
The assessment referred to in Article 17, paragraph 1, letter a), including in the choice of work equipment and chemicals used, as well as the layout of the workplace itself, must cover all risks relating to the safety and health of workers.

The risk assessment is the starting point for protecting the health and safety of workers. As such, employers can “voluntarily” choose to take a step forward, by adopting efficient organisational and management models.

Indeed, Art. 30 of Legislative Decree 81/08 defines the effective requirements of organisational and management models, with the exemption of administrative liability, in accordance with Art. 6 of Legislative Decree no. 231/01.
Paragraph 5 of Art. 30 of Legislative Decree no. 81/08 also identifies the reference model: British Standard OHSAS 18001.
Art. 53 of Legislative Decree no. 81/08 validates the use of automated data processing systems for the storage, access and management of any documentation required by the Consolidated Law on the Health and Safety of Workers
